Legal Port Diaries

Suspension From Work Duties

From the day Judge Tarek Bitar took over the port explosion file on 20 February 2021 until 15 January 2022, he was forced to stop work for 80 days, and the count kept rising, because of repeated requests to remove him from the case ("kaff al-yad").

The paper sets out, in a table, the lawsuits filed against the judicial investigator and other judges between September and December 2021: who filed each one, when, which court heard it and what it decided. It then explains what suspension means in Lebanese law, the gap that lets it be used with no time limit, and the main legal events of January 2022.

Its conclusion: suspension is a right the law guarantees, but its use must have a limit, so that it does not become a way to stand in the way of the truth, escape justice and evade punishment.
